This app itself collects no personal data beyond what is described in this policy. All data you enter is stored locally on your device.
Minors
The app is intended exclusively for adults aged 18 or older, in line with our Terms of Use. We do not knowingly collect personal data from minors.
Bluetooth Connection (optional)
If you optionally connect your device via Bluetooth, we use this interface solely to read device data (e.g., battery status, MAC address).
- No Server Transmission: All data is processed exclusively locally on your smartphone. No data is transmitted to our servers or third parties.
- Legal Basis & Revocation: Processing is based on your consent Art. 6 (1) (a) GDPR (Art. 6 Abs. 1 lit. a DSGVO) granted via the app permission. You can revoke this permission at any time in your smartphone's system settings.
Data Retention and Deletion
We follow a strict 'Privacy by Design' approach. Since all your entries and usage data (such as logged smoking sessions including timestamps and costs, personal app settings, and connected devices) are stored exclusively local within the app's secure sandbox database on your own smartphone, we never have access to this data.
The data remains on your device for as long as you use the app. You have full control over the retention period: you can delete individual entries or reset settings at any time directly within the app. Uninstalling the app from your smartphone will automatically and permanently delete all locally stored data from your device. No server-side archiving or backup storage is performed by us.
Please note: if you have enabled your device's operating system backup (e.g., iCloud Backup on iOS or the Google backup on Android) or a device-to-device transfer, your locally stored app data (entries, settings, connected devices) may be included in it so that you can restore your data when changing or resetting your device. These backups are operated by Apple or Google under their own terms and privacy policies; we have no access to them. You can manage or disable device backups at any time in your device's system settings.
Purchases and Subscriptions
The app's core features can be used free of charge. Certain additional features ("QYSH Pro") can be unlocked with a paid subscription (monthly or annual) or a one-time lifetime purchase, made directly through the Apple App Store or Google Play. The purchase itself, including your payment and billing details, is processed exclusively by Apple Inc. or Google LLC as independent controllers, in accordance with their own privacy policies. We do not receive, process, or store your payment data.
- To grant you access, the app verifies your subscription or purchase status directly with Apple or Google (via StoreKit / Google Play Billing) on your device. We do not operate a backend server for this purpose, and no purchase-related data is transmitted to or stored by us.
- Legal basis: Art. 6(1)(b) GDPR (Art. 6 Abs. 1 lit. b DSGVO), to the extent this constitutes processing of personal data by us at all.
- Third-country transfer: Apple Inc. and Google LLC are based in the USA and are certified under the EU-U.S. Data Privacy Framework.
Checking for Updated Legal Documents (App)
On launch, the app retrieves a small version file (versions.json) from our website (qysh.mircov.de) to check whether the Terms of Use or this privacy policy have changed since you last accepted them. The app itself does not transmit any personal data in this process; however, since the website is hosted on GitHub Pages, GitHub Inc. automatically processes technical data (e.g., your IP address) in server logs when this request is made (see the section 'Domain Infrastructure and Web Hosting').
- Legal basis: Art. 6(1)(f) GDPR (Art. 6 Abs. 1 lit. f DSGVO) – legitimate interest in informing users about changes to the legal documents.
Crash and Diagnostic Reports
If you have enabled the corresponding option in your device settings (e.g., "Share With App Developers" on iOS or "Usage & diagnostics" on Android), Apple and/or Google may share anonymized crash and performance reports with us to help us identify and fix technical issues. This data is provided to us in anonymized or aggregated form and does not allow us to directly identify you.
- Legal basis: Art. 6(1)(f) GDPR (Art. 6 Abs. 1 lit. f DSGVO) – legitimate interest in ensuring the stability and quality of the app, to the extent this constitutes processing of personal data at all.
- You can disable this sharing at any time in your device's system settings.
Contacting us by Email
If you contact us by email (e.g., for support inquiries), your email address and the data contained in the email will be stored by us in order to process your request.
- Legal basis: Art. 6(1)(b) GDPR (Art. 6 Abs. 1 lit. b DSGVO) or Art. 6(1)(f) GDPR (Art. 6 Abs. 1 lit. f DSGVO).
- The data will be deleted as soon as your request has been finally resolved and there are no statutory retention obligations to the contrary.
Domain Infrastructure and Web Hosting (IONOS & GitHub)
For the technical operation of this website, we use services for the provision of the domain and web space hosting.
- Domain & DNS: The domain of this website is registered with IONOS SE. When the domain is accessed, requests are routed through the nameservers of IONOS SE to establish the connection to the website.
- Web hosting: The actual content of this website is provided via GitHub Pages by the provider GitHub Inc. When accessing the page, GitHub automatically processes technical data (e.g., IP address, browser type, operating system, time of access) in server logs.
- Legal basis: Art. 6(1)(f) GDPR (Art. 6 Abs. 1 lit. f DSGVO).
- Third-country transfer: GitHub Inc. is certified under the EU-U.S. Data Privacy Framework, which ensures an adequate level of data protection.
- No cookies are set on this website and no external resources are loaded. Only the language you select is stored locally in your browser (localStorage) so that your choice is remembered on your next visit; this information is not transmitted to us and can be deleted at any time by clearing your browser data.

Rights of Users
You have the right to access, rectification, erasure, and restriction of processing of your personal data, as well as the right to data portability. You also have the right to object, on grounds relating to your particular situation, at any time to the processing of data concerning you which is carried out on the basis of Art. 6(1)(f) GDPR (Art. 6 Abs. 1 lit. f DSGVO). Since the app itself does not collect any data, in practice these rights primarily concern data generated by the website infrastructure (server logs) or via email contact. You also have the right to lodge a complaint with a data protection supervisory authority, in particular the supervisory authority of the German federal state in which you reside. The authority responsible for us is the North Rhine-Westphalia Commissioner for Data Protection and Freedom of Information (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, LDI NRW).
We do not use automated decision-making or profiling within the meaning of Art. 22 GDPR (Art. 22 DSGVO).
